General Terms and Conditions for Events

1. Basics

These General Terms and Conditions for Events (Event Terms and Conditions) govern the legal relationship between the guest (hereinafter referred to as the “Guest”) and Engadin St. Moritz Mountains AG, as the operator of the dining establishments listed below. This applies in connection with the rental of seminar, banquet, and event facilities (hereinafter referred to as “Facilities”) as well as related services or deliveries to and for the customer or event organizer. Please note that these Terms and Conditions always refer to a “contract” with regard to all services. For lodging, the terms and conditions of the lodging establishments apply. Only the terms and conditions of Engadin St. Moritz Mountains AG in effect at the time the contract is concluded shall apply. The guest’s general terms and conditions apply only if this was expressly agreed in writing prior to signing the contract. Should individual provisions of these General Terms and Conditions be ineffective or invalid, this shall not affect the validity of the contract or the remaining provisions of the General Terms and Conditions. In all other respects, the statutory provisions apply. These Terms and Conditions apply exclusively to the Mountains dining establishments (hereinafter referred to as “GB Mountains”). Reservations for seminars, events, or banquets fall within this scope. The organizer’s/renter’s General Terms and Conditions do not apply. These General Terms and Conditions are also available in English. The German version of the General Terms and Conditions is authoritative.

2. Reservation

An offer/confirmation is clearly marked as such and must be signed by the customer and returned to GB Mountains. A quote is valid for 7 days (acceptance period). GB Mountains expressly reserves the right to put the property back on the market during and after the expiration of the acceptance period. In the event of a new inquiry, the second quote may differ from the first quote.

 

3. Prices

Prices vary by venue and can be found in the quote or confirmation for each individual event. We reserve the right to change prices. All prices are in Swiss francs, are net, and include service charges and applicable value-added tax. The prices confirmed in writing by GB Mountains apply.

 

4. Payment

Invoices from Engadin St. Moritz Mountains AG that do not specify a due date are payable in full within 10 days of receipt. Engadin St. Moritz Mountains AG is entitled to declare accrued receivables due at any time and to demand immediate payment. Engadin St. Moritz Mountains AG reserves the right to require an advance payment for events in accordance with the quotation: Engadin St. Moritz Mountains AG is entitled to require a reasonable advance payment or security deposit upon conclusion of the contract or thereafter. The amount of the advance payment and the payment due dates will be specified in the offer.

If there are no separate terms and conditions regarding advance payments, the following rules apply:

  • 50% of the total cost up to 28 days before the event
  • 100% of the total cost up to 7 days before the event

 

5. Cancellation Policy

Cancellations must be made in writing. The following cancellation policy applies:

  • Cancellation is free of charge up to 28 days before the event
  • Cancellation 28 to 14 days before the event: 50% of the total cost
  • Cancellation 14 to 3 days before the event: 80% of the total cost
  • Cancellation 3 to 0 days before the event: 100% of the total cost
  • No-Show: 100% of the total cost

GB Mountains reserves the right to specify individual cancellation policies in the quote. Changes in the number of participants of up to 10% may be reported up to 72 hours before the event and are binding. If the actual number of participants on the day of the event is lower, the definitively confirmed number of participants will serve as the basis for billing. Any additional costs incurred due to extra participants will be billed. The maximum room capacities specified by the fire department must not be exceeded.

 

6. Withdrawal by Engadin St. Moritz Mountains AG 

Up to and including 28 days before the guest’s agreed arrival date, GB Mountains may withdraw from the contract without incurring any costs. Furthermore, GB Mountains is entitled to terminate the contract extraordinarily and with immediate effect at any time for an objectively justified reason by means of an immediate, unilateral written notice. Objectively justified reasons include, for example:

  • An agreed-upon advance payment or security deposit is not made within the timeframe set by GB Mountains.
  • Force majeure or other circumstances beyond GB Mountains’ control that make performance of the contract objectively impossible.
  • Rooms or spaces that are booked or used based on misleading or false information, such as regarding the guest's identity or the purpose of use or stay.
  • GB Mountains has reason to believe that the use of the agreed-upon services may interfere with the smooth operation of the business, the safety of other guests, or the reputation of GB Mountains.
  • The guest has become insolvent (bankruptcy or garnishment) or has suspended payments.
  • The purpose or reason for the stay is unlawful.

If GB Mountains cancels for the reasons stated above, the guest is not entitled to compensation. Furthermore, payment for the booked services remains due in all cases.

 

7. Detailed Information / Procedure

To discuss the details, an appointment must be scheduled in advance. To ensure that the event runs smoothly, all important information (e.g., equipment, menu selections, schedule, entertainment, etc.) must be provided to GB Mountains no later than 10 days before the event. Both parties must strictly adhere to the agreed-upon program times.

 

8. Use of Space

In exceptional cases, GB Mountains is entitled to make last-minute venue changes without prior notice. In any case, GB Mountains reserves the right to provide a venue appropriate for the number of participants and the nature of the event if attendance is lower than expected. Outside the rented premises, reception tables, promotional materials, banners, etc., may only be set up with GB Mountains’ prior approval. If public areas are to be used as part of the event, this must be agreed upon with GB Mountains in advance. Smoking is prohibited in all buildings owned by Engadin St. Moritz Mountains AG.

 

9. Menu Customizations

GB Mountains reserves the right to make adjustments to the menu and changes to the vintages of the wines.

 

10. Tap Fee

As a general rule, the event organizer and their guests are not permitted to bring their own food and beverages to events. Exceptions require a written agreement with GB Mountains. If guests bring their own wine, spirits, cakes, etc., a service charge to cover overhead costs will be added to the total bill. The amount is specified in the event contract.

 

11. Decorations / Flowers

The installation of decorations or other items requires a permit, in part for fire safety reasons. The organizer will be billed for any damage caused during setup, etc.

 

12. Parking

Parking is usually available at or near the event venue. Unless otherwise agreed, the organizer or the individual participants are responsible for any parking fees incurred.

 

13. Technical Equipment and Connections

To the extent that GB Mountains procures technical and other equipment from third parties on behalf of the organizer at the organizer’s request, it acts in the name, under the authority, and for the account of the organizer. The organizer is liable for the careful handling and proper return of such equipment. The organizer indemnifies GB Mountains against all claims by third parties arising from the provision of this equipment. The use of the organizer’s own electrical equipment connected to GB Mountains’ power grid requires prior approval. Any malfunctions or damage to the technical equipment resulting from the use of such devices shall be borne by the organizer, unless GB Mountains is responsible for them. GB Mountains may record and bill the resulting electricity costs on a flat-rate basis. Malfunctions in technical or other equipment provided by GB Mountains will be remedied immediately whenever possible. Payments may not be withheld or reduced unless GB Mountains is responsible for such malfunctions.

 

14. Fire Safety Regulations

The organizer agrees to comply with GB Mountains’ fire safety regulations, particularly regarding keeping escape routes clear, and guarantees that all materials brought onto the premises comply with fire safety guidelines. The use of flammable items is strictly prohibited.

 

15. Delivery and Pickup of Materials 

Deliveries and pickups for events must be coordinated with GB Mountains and communicated to GB Mountains in writing well in advance—at least before the items arrive. GB Mountains reserves the right to refuse shipments without a sender or a valid recipient, including details of the event. GB Mountains disclaims any resulting obligation or liability. Since storage space at GB Mountains is limited, GB Mountains may refuse to accept materials prior to the event date. For shipments from abroad to Switzerland, customs duties and value-added tax (VAT) are always charged in addition to shipping costs. If the carrier is unable to provide the exact costs upon delivery, we reserve the right to charge a flat fee of CHF 150 to the organizer’s invoice.

 

16. Musical entertainment, closing time, additional mountain railway rides, and night surcharge

For events featuring music, please note that after 11:00 p.m., music is permitted only at a moderate volume. DJs and bands are required to keep the bass level low and to cover the floor beneath the instruments with a carpet to dampen sound. The maximum performance time is until 2:00 a.m. Failure to comply with these instructions will result in additional costs being charged to the event organizer. The event organizer is responsible for clarifying any copyright fees related to musical performances and must cover these costs. If an event lasts longer than the legally permitted closing time, a nighttime surcharge must be paid. The extension of the closing time must be reported to the venue no later than 4 weeks before the event. The required police permit will be obtained by the venue and billed to the organizer. Guests who are outdoors are asked to behave quietly. Instructions from staff must be followed. The organizer is liable for any complaints and potential fines. For staff working at the event, a surcharge per hour will be billed starting at 11:00 p.m. in accordance with the event contract. A separate quote will be provided for train rides outside of regular public service hours. If the train is made available for longer than requested and contractually agreed upon, the actual service provided will be billed. Engadin St. Moritz Mountains AG shall decide whether to operate additional trips. If an additional trip is not operated (due to weather, technical malfunctions, etc.), no claims may be asserted.

 

17. Guest Room

The “General Terms and Conditions for Accommodation” apply to guest room reservations. For events involving overnight stays, the hotel must receive a room list from the event organizer no later than 14 days before the guests’ arrival, containing the following information for each guest: First and last names / Check-in and check-out dates / Payment terms. In the event of a block reservation without a room list provided by the event organizer, guests must book the hotel rooms directly and guarantee each reservation individually using a valid credit card. After the deadline set by the hotels has passed, any remaining available rooms in the respective block will be released for general sale. The organizer is liable in all cases for any unpaid costs associated with rooms booked by its guests and their on-site purchases (no-shows, etc.).

 

18. Liability / Duty of Care 

The guest must use the facilities and materials provided with the utmost care. The organizer is responsible in all cases for any property damage or loss that occurs. GB Mountains disclaims all liability for theft, damage, and services provided by third parties. This also applies to personal injury, unless such injury was caused by GB Mountains employees. GB Mountains is liable to the extent permitted by law.

 

19. Data Protection

With regard to data protection, the provisions of Engadin St. Moritz Mountains AG apply.

 

20. Final Provisions

In addition to the “Event Terms and Conditions,” other provisions and booking conditions may apply, which take precedence over the “Event Terms and Conditions.” Any changes or additions to the accepted offer or to these “Event Terms and Conditions” must be made in writing. Unilateral changes or additions made by the organizer are invalid. The place of performance and payment is Engadin St. Moritz Mountains AG. Swiss law applies, with exclusive jurisdiction in Maloja. Should individual provisions of these “Event Terms and Conditions” be or become invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions apply.
